This is the U.S. Department of Education’s codified regulations of the protection of human
subjects in research. The language in subpart A of these regulations is identical to that of the
Department of Health and Human Services Policy for the Protection of Human Subjects (45 CFR
part 46, subpart A). The language in other subparts is unique to the Department of Education.

This applies to programs that receive funding from the U.S. Department of Education. It outlines
the rights of parents and students involved in research in an educational setting.
FERPA is the U.S. Department of Education’s policy regarding the protection of students’
education records. It is applicable to research projects that involve access not only to school
educational records, but also to students and school directory information.
